Terms and Conditions

Please read these terms carefully before using the Eco Trade Portal platform and directory services.

1. Introduction and Acceptance of Terms

Welcome to the Eco Trade Portal ("we," "our," "us," or the "Platform"). These Terms and Conditions ("Terms") govern your access to and use of the Eco Trade Portal website, mobile applications, and any related services. By accessing, browsing, registering an account, or listing a business on our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

Eco Trade Portal operates strictly as an online business directory and discovery platform. We provide a digital venue for users to list their businesses, services, and professional contact details, allowing other users to discover and communicate with them. We are not an e-commerce store, a broker, an agent, or an active participant in any transaction between users. If you do not agree with these Terms, you are expressly prohibited from using the Platform and must discontinue use immediately.

2. Eligibility

To use the Platform and create a business listing, you must meet the following criteria:

  • You must be at least eighteen (18) years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872.
  • If you are registering or operating an account on behalf of a business entity, corporate body, or organization, you represent and warrant that you possess the legal authority to bind that entity to these Terms.
  • Your use of the Platform must not violate any applicable local, state, national, or international laws or regulations.

3. User Accounts, Registration, and Security

While some areas of the Platform may be accessed without an account, creating a business listing requires user registration.

  • Accurate Information: You agree to provide true, accurate, current, and complete information during the registration process and to continually update this information to maintain its accuracy.
  • Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to accept responsibility for all activities, unauthorized or otherwise, that occur under your account.
  • Notification of Breach: You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to safeguard your account.

4. Listing Rules and User Responsibilities

Eco Trade Portal empowers businesses to showcase their services. However, to maintain the integrity of our directory, users must adhere to strict listing standards:

  • Factual Accuracy: All business descriptions, addresses, contact numbers, and service offerings must be strictly factual and represent a real, currently operating business.
  • Categorization: Listings must be placed in the most appropriate and accurate business category available on the Platform.
  • User Liability: You bear absolute legal and financial responsibility for the contents of your listing. Eco Trade Portal does not independently verify, endorse, or guarantee the accuracy, quality, or legitimacy of any business listed.

5. Prohibited Activities

To ensure a safe and professional environment, the following activities are strictly prohibited. Engaging in any of these will result in immediate account termination and potential legal action:

  • Fraud and Fake Listings: Creating listings for non-existent businesses, shell companies, or attempting to impersonate another person, brand, or business entity.
  • Illegal Content: Posting content that promotes illegal acts, explicit material, counterfeit goods, stolen products, or services that violate Indian law.
  • Spam: Utilizing the directory or our internal contact forms to transmit unsolicited bulk emails, promotional spam, pyramid schemes, or unauthorized advertising.
  • Malicious Code: Uploading files that contain viruses, Trojan horses, malware, or any other software designed to disrupt or damage the Platform.
  • Data Scraping: Using automated scripts, bots, spiders, or scrapers to extract data, business contacts, or user information from the Platform without our explicit written consent.

6. Content Ownership and Intellectual Property

Your Content: You retain all ownership rights to the text, images, logos, and other materials you upload to your business listing ("User Content"). However, by submitting User Content to the Platform, you grant Eco Trade Portal a worldwide, non-exclusive, royalty-free, transferable, and sub-licensable license to use, reproduce, distribute, prepare derivative works of, and publicly display that content in connection with operating and promoting the Platform.

Our Intellectual Property: The Eco Trade Portal platform, including its codebase, institutional-grade web design, UI/UX aesthetics, proprietary algorithms, and brand logos, are the exclusive intellectual property of Eco Trade Portal and are protected by applicable copyright and trademark laws. You may not copy, reverse-engineer, or distribute our intellectual property without prior written permission.

7. Moderation and Removal Rights

Eco Trade Portal reserves the absolute right, though not the obligation, to monitor, review, edit, suspend, or permanently remove any user account or business listing at our sole discretion, at any time, and without prior notice. Reasons for removal may include, but are not limited to, violations of these Terms, prolonged account inactivity, reports of fraudulent behavior, or content that we deem detrimental to the Platform's reputation.

8. Disclaimer Regarding User-to-User Transactions

We are a Directory, Not a Party to Transactions. Eco Trade Portal solely provides the infrastructure for businesses and consumers to discover one another. We are entirely independent of any contracts, agreements, payments, or deliveries made between users and listed businesses.

  • We do not guarantee the quality, safety, or legality of the services or goods advertised by listed businesses.
  • We are not responsible for any non-payment, non-delivery, or contractual breaches by any party.
  • Any dispute arising from a transaction initiated through information found on the Platform must be resolved directly between the buyer and the business. Eco Trade Portal will not mediate, arbitrate, or involve itself in such disputes.

9. Payments and Premium Services

While basic business listings may be offered free of charge, Eco Trade Portal may offer optional premium features, such as enhanced visibility, verified badges, or advertising placements. All payments for premium services are subject to the pricing displayed at the checkout process. Unless otherwise mandated by law, all fees paid for premium listing services are strictly non-refundable, regardless of whether your account is subsequently suspended for violating these Terms. Users are responsible for all applicable taxes, including GST, associated with their purchases on the Platform.

10. Privacy and Data Usage

Your privacy is important to us. By creating a listing, you understand that the business information you provide is intended for public consumption and will be visible on the internet. Your private account credentials and billing information are handled securely. 11. Third-Party Links and External Websites

Listings on the Platform may contain links to external websites operated by third parties (e.g., a business's official website). Eco Trade Portal does not monitor, endorse, or assume any responsibility for the content, privacy policies, or practices of any third-party websites. Accessing external links is done entirely at your own risk.

12. Limitation of Liability and Disclaimers

Please read this section carefully as it limits the liability of Eco Trade Portal.

THE PLATFORM AND ALL CONTENT THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ECO TRADE PORTAL EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ECO TRADE PORTAL, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE PLATFORM. IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF ONE THOUSAND INDIAN RUPEES (INR 1000) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS FOR PREMIUM SERVICES.

13. Indemnification

You agree to defend, indemnify, and hold harmless Eco Trade Portal, its affiliates, officers, and employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms, your User Content, or your interactions with any other user of the Platform.

14. Account Suspension and Termination

You may terminate your account at any time by contacting us or using the deletion tools provided in your dashboard. We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation a breach of the Terms. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Dispute Resolution and Governing Law

These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Platform shall be instituted exclusively in the competent courts located in Ludhiana, Punjab, India. By using this Platform, you waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

16. Changes to These Terms

We reserve the right to modify or replace these Terms at any time to reflect changes in our services, legal requirements, or business practices. If a revision is material, we will try to provide at least 15 days' notice prior to any new terms taking effect. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
